Nutzungsbedingungen der camping.info gmbh für die von ihr im Rahmen des Systems „camping.info“ betriebenen Internetangebote

1. Mit der Nutzung dieses Service erkennen Sie die Nutzungsbedingungen an.
    
2. Diese Nutzungsbedingungen und Haftungsausschlüsse gelten auch als Teil all jener Internetangebote der camping.info gmbh, von denen aus auf diese Seite verwiesen wurde.
    
3. camping.info steht sowohl Campingplätzen als auch Besuchern (Campern) grundsätzlich kostenlos zur Verfügung. Die camping.info gmbh behält sich das Recht vor, Campingplätze oder Besucher ohne Angabe von Gründen und ohne vorherige Ankündigung vom System auszuschließen sowie Inhalte zu löschen oder zu ändern. Dies gilt insbesondere für gesetzwidrige oder sittenwidrige Inhalte.
    
4. camping.info bemüht sich um eine bestmögliche Funktionstüchtigkeit seines Service. Die camping.info gmbh haftet jedoch nicht für entstandene Schäden oder entgangene Einnahmen aufgrund von Fehlern, Ausfällen oder Stilllegung des Systems.
    
5. Ohne Zustimmung durch die camping.info gmbh dürfen keine Inhalte oder Systembestandteile an anderer Stelle veröffentlicht werden.
    
6. Ein Campingplatz der auf camping.info nicht präsentiert werden möchte, wird redaktionell gelöscht. Bitte hierzu um Mitteilung mittels Kontakt-Formular.
    
7. camping.info versucht durch zahlreiche Instrumente und Maßnahmen die angebotenen Inhalte und Informationen in bestmöglicher Qualität zur Verfügung zu stellen und ständig zu verbessern. Es erfolgen jedoch alle Angaben ohne Gewähr. Der Großteil der Informationen stammt direkt von Campingplätzen und Campern. Die camping.info gmbh haftet nicht für die Richtigkeit, Vollständigkeit oder Aktualität der veröffentlichten Informationen (Texte, Daten, Preise, Bilder etc.). Außerdem wird keine Gewähr übernommen für Inhalte auf welche in diesem System verlinkt wird (Links auf externe Seiten).
    
8. Alle Nutzer des Systems (sowohl Campingplätze als auch Besucher) stimmen ein, dass alle Inhalte und Informationen (Texte, Daten, Bilder etc.) welche von diesen eingegeben oder bestätigt werden, sowohl im Internet als auch in gedruckter Form frei veröffentlicht werden dürfen. Die Inhalte können insbesondere nicht nur auf www.camping.info angezeigt werden, sondern (zB im Rahmen von Content-Sharing) auch auf anderen Seiten. Die Nutzer garantieren, Inhaber sämtlicher Rechte an den von ihnen eingegebenen Inhalten zu sein und gewähren der camping.info gmbh unentgeltlich ein sachlich, räumlich und zeitlich unbeschränktes Nutzungsrecht dieser Inhalte. Durch das Bereitstellen (Hochladen) von Bild- oder sonstigen Daten erklärt der Benutzer ausdrücklich, dass diese Daten keinerlei Rechte von Dritten verletzen und gegen keinerlei gesetzliche Bestimmungen verstoßen. Weiters erklärt der Bereitsteller, dass er über die erforderlichen Urheber-, Bildnis- und Fotorechte für die Bereitstellung verfügt und unser Unternehmen und dessen Angehörige gegenüber Ansprüchen von Dritten schad- und klaglos hält.
    
9. Die Nutzer gewährleisten, dass die von ihnen eingegebenen Inhalte nicht vertraulich sind und nicht gegen geltendes Recht verstoßen. Die camping.info gmbh behält sich das Recht vor - sofern es aus rechtlichen Gründen nötig oder sinnvoll erscheint - ohne Benachrichtigung des Nutzers jedoch unter Wahrung des Urheberrechts, Inhalte der Autoren ganz oder teilweise zu löschen oder zu ändern.
    
10. Wesentliche Teile der Inhalte dieses Systems werden nicht redaktionell sondern zB durch Campingplätze oder Campinggäste verwaltet. Illegale oder anstößige Inhalte können durch ein im System eingebautes Melde-System rasch und einfach an die Redaktion gemeldet werden und werden nach einer redaktionellen Überprüfung schnellst möglich gelöscht. Verwenden Sie hierzu die jeweiligen Kontakt-Formulare. Eine vollständige und sofortige Überprüfung aller Inhalte (welche sich zum Teil ständig ändern) ist jedoch nicht möglich. Für die Legalität der Inhalte sind die jeweiligen Autoren selbst verantwortlich.
     
11. Durch die Veröffentlichung der Informationen durch die camping.info gmbh bzw. das Abrufen solcher durch den Nutzer erfolgt keine verbindliche Auskunft oder Beratung. Die Nutzer erklären sich damit einverstanden, diese Inhalte auf eigenes Risiko zu nützen. Dies gilt auch für die von jedermann editierbaren Teile des Systems, es handelt sich dabei um öffentliche Kommunikation.
     
12. Es ist den Nutzern nicht erlaubt, persönliche Daten anderer Nutzer oder deren Informationen zu sammeln oder zu veröffentlichen.
     
13. Die im System zur Verfügung stehenden Kontaktformulare dürfen lediglich für den jeweils gedachten Zweck verwendet werden (zB Anfrage an einen Campingplatz). Die Verwendung dieser Formulare zur Übermittlung von Werbebotschaften oder Spam-Mails ist untersagt.
     
14. Soweit rechtlich möglich, haftet die camping.info gmbh nicht für Schäden, die durch Viren oder sonstige Datenanordnungen in den auf den Webseiten dargestellten Inhalten verursacht werden.
     
15. Es gilt das Recht der Republik Österreich, soweit dem keine international zwingenden gesetzlichen Vorschriften entgegenstehen. Gerichtsstand ist der Sitz der camping.info gmbh. Diese Bedingungen gelten auch dann, wenn die Nutzung der Webseiten von außerhalb der Europäischen Union oder außerhalb Österreichs erfolgt, ungeachtet der Staatsangehörigkeit des Nutzers.
     
16. Die camping.info gmbh behält sich das Recht vor, diese Bedingungen jederzeit zu ändern.
     
17. Sollten Teile dieser Nutzungsbedingungen nicht dem geltenden Recht entsprechen, bleiben die übrigen Teile in ihrem Inhalt und ihrer Gültigkeit davon unberührt und der ungültige Teil gilt als durch einen solchen ersetzt, der dem Sinn und Zweck des unwirksamen Teils bzw. dem Parteiwillen in rechtswirksamer Weise wirtschaftlich am nächsten kommt.

2. These conditions of use and disclaimers of liability are also applicable as part of all Internet services of camping.info gmbh from which you have been referred to this page.
    
3. On principle, camping.info is available to camping sites as well as to visitors (campers) free of charge. camping.info gmbh reserves the right to bar camping sites or visitors from the system without giving reasons and without prior announcements and to delete or modify contents. This applies in particular to illegal or immoral contents.
    
4. camping.info strives towards the best possible functionality of its service. camping.info gmbh, however, is not liable for damages arisen or income lost on account of defects, failures or discontinuation of the system.
    
5. Contents or system components must not be published elsewhere without the consent of camping.info gmbh.
    
6. A comping site that does not wish to be presented on camping.info will be deleted by the editors. In this case, please send a communication using the contact form.
    
7. camping.info attempts to make available in the best possible quality and to constantly improve the contents and information offered through a large number of instruments and measures. No responsibility, however, is accepted for the accuracy of the information. The majority of the information directly comes from camping sites and campers. camping.info gmbh is not liable for the accuracy, completeness and timeliness of the information published (texts, data, prices, pictures, etc.). No responsibility is accepted for contents of linked Web sites (links to external pages).
    
8. All users of the system (camping sites as well as visitors) accept that all contents and information (texts, data, pictures, etc.) entered or confirmed by them may be freely published in the Internet and in printed form. The contents may in particular be shown not only on www.camping.info, but on other sites as well (e.g. in the framework of content sharing). The users guarantee to be the holders of all rights to the contents entered and to grant camping.info gmbh a right to use these contents without restriction in terms of material, space and time. By allocating (uploading) of pictures or other data, the user explicit confirms that this does not infringe on third parties rights and does not infringe on law. Further the user declares that he has the required copyrights/moral rights for the provision at his disposal, and holds our business and its members indemnified against loss and lawsuits.
    
9. The users guarantee that the contents entered by them are not confidential and are not in breach of applicable law. camping.info gmbh reserves the right – as far as it seems necessary or useful for legal reasons – to completely or partly delete or modify contents of the authors without announcing this to the users, but without prejudice to the copyright.
    
10. Essential parts of the contents of this system are not administered by the editors, but e.g. by camping sites or campers. Illegal or objectionable contents may be reported to the editors quickly and easily through a report system integrated in the system and will be deleted as quickly as possible after examination by the editors. In this context, use the appropriate contact forms. A complete and immediate examination of all contents (which are partly constantly changing), however, is not possible. The respective authors themselves are responsible for the legality of the contents.
     
11. The publication of information through camping.info gmbh and/or the calling of such information by the user do not constitute a binding information or advice. The users agree to use these contents on their own risk. The same is valid for the parts of the system that may be edited by anybody, this is public communication.
     
12. The users are not allowed to collect or to publish other user’s personal data or information.
     
13. The contact forms available in the system must only be used for the purpose respectively intended (e.g. enquiry to a camping site). The use of these forms for sending advertising messages or spam mails is forbidden.
     
14. To the extent permissible by law, camping.info gmbh is not liable for damages caused by viruses or other data organisations in the contents presented on the Web sites.
     
15. The law of the Republic of Austria is applicable unless any internationally binding legal dispositions conflict with it. Place of jurisdiction is the registered office of camping.info gmbh. These conditions will also be valid when the Web sites are used outside the European Union or outside Austria regardless of the user’s nationality.
     
16. camping.info gmbh reserves the right to modify these conditions at any time.
     
17. If any provisions of these conditions of use do not comply with the applicable law, the content and the validity of the other provisions will remain unaffected by this and the invalid provision shall be considered to be replaced by such a legally valid provision coming nearest to the economic purpose intended by the invalid provision and/or the parties.
